摘　　要：人工神经网络技术的出现使机器拥有了自我学习的能力,也使人们开始深思机器"创作"的可能性。人工神经网络工作的原理是基于一定的运算规则输出结果。这些规则虽然是由人工神经网络自我调节形成,但在其研发完成之际已经固定。所谓人工神经网络的"创作"过程仅是运用既定规则的运算过程,人工神经网络本身的运行无法产生版权法意义上的作品。输出结果能否受到版权法保护以及能受到什么样的保护,关键是人在最终的输出结果中起到了什么样的作用。如果人工神经网络系统是辅助人类创作的中介工具,输出结果的实质性部分由人类完成,那么输出结果可以被认定为作品。如果人类在最终的输出结果中所起的作用为零或者过于微小,则不宜将输出结果认定为作品并赋予其版权法保护,而应当在立法上新设邻接权,对投资者进行保护。The advent of artificial neural network technology has enabled the machine to acquire the ability of self-learning and also made people begin to ponder the possibility of ＂creation＂by the machine. The essence of the artificial neural network is based on certain computing rules that output results.Although these rules are formed by the self-regulation of the neural network,they have been fixed in the procedure of the research and development. The so-called ＂creative＂process of artificial neural network is only the process of computing according to established rules. It is impossible to produce the creations in the sense of copyright lawonly by the operation of artificial neural network itself. Whether the output can be protected by the copyright lawand what kind of protection it can take depends on what role human-beings play in the final output. If the artificial neural network system is an intermediary tool to assist human creation and the substantive part of the results is completed by humans,then the output can be identified as a creation. If human beings do not play any role or just play a very insignificant role in the final output,it is not appropriate to consider the output as a creation with granted copyright protection. It is advised that a newneighboring right should be established to protect investors.
