摘 要:国防专利是国防技术领域大量优秀科研成果的结晶,是国防和军队发展的战略性资源,构成了国防科技创新发展的重要支撑力量。在军民融合上升为国家战略的大背景下,国防专利运营尚处于探索和起步阶段。推动国防专利运营开展,必须要从国防专利的产权属性、资本属性出发,基于新制度经济学的交易费用理论、产权理论、制度变迁理论分析,从市场经济下的政府职能出发,以市场化模式进行国防创新系统管理的顶层制度设计,在优化产权归属,明确各方权利义务,健全激励机制,优化治理模式,降低产权交易成本等方面完善国防专利运营制度体系。National defense patents assemble many outstanding scientific research achievements. They are both important strategic resources for national defense and military development and important support for the national defense scientific and technological innovation. While the integration between military and civil sector is growing into national strategy, the national defense patent operation is still in its infancy stage. To promote national defense patent operation development, the paper suggests starting from the property and capital attribute of national defense patent, to carry out top design for national defense innovation system by way of market model and based on transaction cost theory of new institutional economics, property right theory, and the institution evolvement theory, meanwhile taking the government function under market economy into consideration. The paper further suggests to improve national defense patent operation system through optimizing property ownership, clarify rights and obligations for all parties, enhance incentive mechanism, better governance model, and lower property right transaction cost.
