摘 要:当前我国司法机关人员管理体制改革尚需实时科学的实证评估,深入分析司法成本效益问题,建立具有理论基础的论述体系,构建团队合作透明高效的司法人力制度和遵循司法规律、合乎管理科学的基本理论。司法机关人员管理的理想模式应为带有司法委员会型管理模式特点与性质的行政型司法管理模式。该模式符合职业分类授权、运行节点控权、体制架构衡权的管理思路,并能实现专业分类、纵横结合、适当集权、合理参与。China 's current reform of judicial personnel management system still exists some problems which need to be considered,such as the need of real-time scientific empirical evaluation,the in-depth analysis of the judicial cost benefit,the establishment of system with theoretical basis,the construction of a transparent and efficient judicial human resources system for team cooperation,the follow of the law of justice,the basic theory of management science,etc.. The ideal mode of personnel management in China 's judicial organs should be the administrative mode of judicial administration with the characteristics and nature of the judicial committee type management mode. The model is in line with the management ideas of the professional classification authority,the operation node control and the system structure,and also can realize the professional classification,vertical and horizontal combination,proper centralization and reasonable participation.
