我国社会保障双边合作的主要困境及对策研究

摘　　要：虽然我国在社会保障双边合作领域取得了一些成就,但是仍然面临发展进程缓慢、合作内容狭窄、合作方式单一、覆盖面偏低以及社会保障双边协定的执行效果不佳等诸多困境。这些困境的成因是多维的,主要体现在政府的重视程度不高、往来的劳动者数量不对称、没有充分利用利益杠杆、法制规范不健全、不重视国际劳工标准、配套设施不足以及跨国劳动者的社会保障权益保护意识淡薄七个方面。为此,政府应当采取一系列措施,从发挥政府的主导作用、充分利用利益杠杆、加强立法工作、重视国际劳工标准、完善配套设施以及增强跨国劳动者的社会保障权益保护意识等方面来完善我国社会保障双边合作,以有效地维护跨国劳动者的社会保障权益。Although China has made some achievements in the field of the bilateral cooperation of social security, it still faces many difficulties, such as the development process is slow, the content of cooperation is narrow, the cooperation mode is single, the coverage is low, and the bilateral social security agreements＇ effect is not satisfactory etc.. The causes of these difficulties is multidimensional, it is mainly embodied in seven aspects, such as the government is not paying enough attention, the number of workers is asymmetry between the two sides, it doesn＇ t make full use of the lever of interest, the legal norms are not perfect, it doesn ＇ t attach importance to international labor standards, lack of supporting facilities and the transnational workers＇ consciousness of protecting the rights and interests in social security is weak etc.. Therefore, the government should take a series of measures, perfecting the international cooperation of social security in our country by playing the leading role of the government, making full use of the lever of interest, strengthening legislative work, paying attention to the international labor standards, improving the supporting facilities and enhancing the transnational workers＇ awareness of rights and interests in social security and so on, in order to effectively safeguard the rights and interests of social security of the overseas workers.
