摘　　要：科技报告制度以开放共享和促进创新为宗旨;知识产权制度以私权保护和利益平衡为目标,它们本属不同领域,却因部分客体的重叠与目标宗旨的差异而产生了冲突。冲突主要表现为开放不当对科技成果新颖性或秘密性的破坏,此种破坏将导致科技成果所有人或科技成果受让人不能取得,或者丧失已经取得的知识产权,进而影响到科技成果的转化。虽然现行科技报告制度要求开放共享应保障项目承担单位的合法权益,开放的信息不得涉及国家秘密和商业秘密,但缺少具体的保障措施。此外,现行延期公开制度采用了"一刀切"的设计,不利于提升我国的创新能力。基于此,应从增加通知义务,增加保密义务,完善摘要公开,区分科技报告类型分别设置不同的延期公开期限,增加不公开科技报告类型5个方面完善科技报告制度。Scientific and technical report system aims at open sharing and promotion of innovation,while intellectual property rights system focuses on protection of private rights and balance of interests. The two belong to different domains,but they become conflict due to the overlap of objects and different purposes. If scientific and technical reports have been opened improperly,the novelty and secrecy of scientific and technical achievements would be destroyed. As a result,project units or transferees of scientific and technical achievements would not be authorized intellectual property right,or would be forfeited their rights. And it further influences the transformation of scientific and technical achievements. Although there are rules in existing scientific and technical report system to protect project units＇ legal rights and interests by stating that no national secrets or commercial secrets should be involved in open information,there are not concrete measures. In addition,postponed time limit of opening is just the same for all kinds of scientific and technical reports,which impedes promotion of innovation capability. Therefore institution of classified management should be improved from the aspects of enhancing notification obligation and confidentiality obligation,improving the disclosure of the abstract,designing different postponing disclosure periods for different types of technical reports,and increasing the private scientific and technical report types.
