摘 要:戏仿作品在我国互联网上早已存在,但其是否属于侵权却颇具争议,我国著作权法目前尚未对戏仿作品的合法性作出明确规定。谷阿莫的戏仿作品并不构成对他人复制权、保护作品完整权、信息网络传播权和演绎权的侵犯。相反,虽然谷阿莫的戏仿作品构成商业性使用,但鉴于其较大的"转换性使用"程度和对原作权利人利益的有限影响,仍可以主张合理使用的抗辩。对其的著作权保护水平认定应当在言论自由与著作权保护两者之间寻求平衡,并应当符合经济文化的发展现状。Parody works has long existed on the Internet in China. However, whether parody works constitutes infringement is controversial. In China, we have not made explicit provisions on the legitimacy of parody works in Copyright Law. For example Gu Ammo's works does not constitute infringement to others' rights on reproduction, integrity, online information dissemination, and deduction. On the contrary, although his works constitutes a commercial use, it can still claim the defense for fair use in light of its greater "transitional use"and its limited influence on the interests of the people holding original right. As to the determination of the legitimacy of parody works, we should not only seek balance between the freedom of expression and copyright protection, but also follow the status quo of Chinese economic and cultural development.
