摘 要:农村土地"三权分置"改革是党中央倡导的集体土地产权的改革方向,农村土地"三权分置"一系列问题如法律属性、改革实践、制度创新等由此纳入理论学界研究视野,亦引发争议。"三权分置"改革中,农村集体土地应当着重解决所有权主体缺位、集体经济组织概念模糊等问题;应当在强调农户承包权身份属性的同时注重其财产属性;强调新创设的不具有身份属性的土地经营权的物权属性,强化其抵押融资的收益、处分权能。在制度构建上,应当改进集体农民身份的法律标准,完善土地经营权的理论基础和基本权能,建立农村土地"三权分置"的制度保障和配套措施。The reform of "the division of the three rights" in rural land is the direction of the reform of collective land property rights initiated by the Party Central Committee. The series of issues concerning the "the division of the three rights" of rural land, such as legal attributes, reform practices, institutional innovations, etc. , have thus become controversial since they have been incorporated into the field of theoretical studies. In the reform of the division of the three rights, the collective land in rural areas should focus on solving the problems such as the absence of the main body of ownership and the vague concept of the collective economic organization, etc. The emphasis should be placed on the property attributes of rural households while emphasizing the identity of rural households; emphasizing the property rights attributes of newly created land management rights that do not have identity attributes, and strengthening their right to harvest and disposal of mortgage financing. In regard to system construction, it is necessary to improve the legal standards for the identity of collective farmers as well as the theoretical basis and basic power of land management rights, and establish the institutional guarantees and supporting measures for the "the division of the three rights" of rural land.
