摘 要:"产权式商铺"分割方式作为一种新型的房地产产品形式,实践中纠纷不断,审判案由不一,故处于弱势的购铺者的权利未能得到合理的保护。以一个现实案件为例,以出现最多的纠纷问题即"虚拟产权式商铺购买者要求返还商铺的诉求能否支持"入手,探讨虚拟产权式商铺的纠纷问题,分析购铺者的权利性质,提出保障购铺者权利行使的建议,从而促进司法审判的规范,以追求更为良好的社会效果。As a new form of real estate products, " property-style shops " segmentation leads to the disputes in practice,and the causes of the jurisdiction are different,and the rights of the buyers in the weak position can not be reasonably protected. The paper grasps the emergence of the most controversial issues,such as "if the claim of the virtual " property-style shops " buyers who wants to have their shops back can be supported",to analyze the nature of the right of the buyers and put forward some proposals to protect the exercise of the right of the buyers and to help the normalization of judicial trial.
