探求城管行政执法的伦理维度

摘　　要：我国的城市综合管理离不开城管,城管行政执法是维护社会和谐稳定的发展秩序的一个有效手段。国内城管行政执法过程中,暴露出诸如权力边界模糊、执法方式简单粗暴、执法行为缺乏法律依据等问题,亟需合理借鉴域外城市综合管理经验,立足于我国的国情社情,探求法治与伦理并重的城管行政执法模式。通过道德力量规约行政权力、柔性执法、丰富执法方式以及德与法的双向互动规范执法依据等手段,打造德法并举的城管行政执法团队,从而在良法善治的大环境下实现对城管行政执法的有效伦理回护。China ＇s urban comprehensive management can not be separated from urban management, urban managernent administrative law enforcement is an effective means to maintain social harmony and stability of the development order. During the urban administrative law enforcement process,there exposed problems such as fuzzy power boundary,simple and crude way of law enforcement actions,and the lack of legal basis in law enforcement. It is an urgent need to learn from foreign urban comprehensive management experience. Based on China＇s national and social conditions,this paper explores urban management law enforcement mode by the rule of law and ethics. Only by constructing the moral force to constrain administrative power and with new ways of law erforcement such as soft law enforcement,and then by building interaction between morality and law norms according to law enforcement and other means,can we create an urban management administrative law enforcement team of virtue and law. In this way,the purposes of urban management administrative law enforcement can be achieved.
