摘 要:《精神卫生法》确立了非刑事精神障碍强制医疗制度,但该制度在启动程序上却有待完善的地方:一是不能很好地保障被强制医疗人的人身自由和健康权;二是在具体设计上,存在决定主体有缺陷、鉴定治疗一体化不合理、未建立告知制度、先行收治缺乏正当程序和监督制度缺乏等弊端。鉴此,应统一送治主体、确立"鉴定与治疗分离"原则、建立告知制度、取消先行收治和完善监督制度,才能充分保障被强制医疗人的合法权益。Compulsory medical system for non-criminal mental disorders was established in Mental Health Act enacted in 2012 in China. However, this system needs to be improved in the start-up procedure: 1. The right to personal freedom and health cannot be well protected; 2. In the specific design, there are some disadvantages, such as the defect of determining subjects, unreasonable integration of appraisal and treatment,no notification system, no dueprocess for preemption and lack of supervision system, etc.. Therefore, in order to fully protect the legitimate rights and interests of the compulsory medical persons, it is necessary to unify the main body of determining, establish theprinciple of "separation of appraisal and treatment", establish the notification system, cancel preemption and improve the supervision system.
