因婚外同居引起的离婚损害赔偿举证难问题研究

摘　　要：随着离婚率的不断提高,提起的离婚损害赔偿诉讼占据离婚案件的比例也日益增多,其中因婚外同居而导致的离婚损害赔偿诉讼中举证难现象普遍存在。根据司法实践中的举证难问题,本文将重点分析因婚外同居、婚外情引起的离婚损害赔偿案件中举证困难发生原因的制度困境和现实困境,提出了解决思路,希望为该制度困境的化解提供一些有价值的参考。While the divorce rate continuing to increase, the proportion of the divorce damages litigation in divorce cases is growing as well, among which there is a common phenomenon in the case of divorce damage compensation litigation caused by cohabitation outside marriage. According to the difficult problem of proof in judicial practice, this article will focus on the analysis of the institutional and realistic predicaments of the reasons for the difficulties in the indemnity of divorce damages caused by marital cohabitation and extramarital affair, and put forward some solutions to provide some valuable reference for the solution of the system dilemma.
