3D打印技术发展背景下我国专利法律制度的完善

摘　　要：人类社会在历经电力革命与蒸汽革命后,迎来了第三次工业革命——科技革命,其中包括生物工程、原子能、空间技术等。在诸多制造技术中,3D打印被称为"具有工业革命意义的制造技术"。不同于传统的制造技术,3D打印技术具有生产周期短、原料消耗少、产品精度高、个性化生产等诸多优势,随着3D打印机价格的下降,其正逐渐向家庭式个人应用发展。3D打印技术在不断发展的同时,也对知识产权法尤其是专利权法进行着冲击。家庭式3D打印技术的成熟与我国《专利法》等众多法律产生的冲突,集中体现在打印出的产品是否构成专利侵权。对于该技术产生的专利权纠纷问题,应对现行《专利法》进行重新审视,在对科技发展、经济价值、社会影响等方面进行平衡的基础上,推动3D打印技术和专利法律制度之间的互动演进式发展。After the power revolution and the steam revolution,human society has ushered in the third industrial revolution：the scientific and technological revolution,including biological engineering,atomic energy and space technology.Among many manufacturing technologies,3 D printing is referred to as＂manufacturing technology with industrial revolution significance.＂Different from traditional manufacturing technologies,3 Dprinting technology has many advantages such as short production cycle,low raw material consumption,high product precision and personalized production.With the declining prices of 3 D printers,it is gradually developing for home-based personal applications.With the continuous development of 3 Dprinting technology,it also has an impact on intellectual property laws,especially patent rights law.The conflict between the maturity of home-based 3 Dprinting technology and many laws such as China＇s＂Patent Law＂is reflected in whether the printed products constitute patent infringement.Regarding the issue of patent rights disputes arising from this technology,the current Patent Lawshould be reexamined to promote the interactive evolutionary development between 3 Dprinting technology and the patent legal system on the basis of balancing scientific and technological development,economic value and social influence.
