摘　　要：类型研究,对于兴奋剂行为的刑法解析至关重要,是实现行为犯罪化的前提条件,罪名解析的逻辑前提,对兴奋剂行为的刑事立法具有修正作用。兴奋剂行为按照所侵犯的法益分为侵犯社会主义市场经济秩序、妨害社会管理秩序、侵犯公民人身权利、渎职类的兴奋剂行为。首先,侵犯社会主义市场经济秩序的兴奋剂行为主要表现为生产、销售药品类兴奋剂的行为,对其可以按照生产、销售假药罪处理,但考虑到有类推解释的嫌疑,应当及时设立生产、销售兴奋剂罪。其次,妨害社会管理秩序的兴奋剂行为,既囊括了毒品类、妨害公务、提供作弊器材等犯罪,又包括在体育考试、比赛中使用兴奋剂的一般违法行为。最后,侵犯公民人身权利的兴奋剂犯罪主要包括强迫、引诱、欺骗、威胁他人使用药品类兴奋剂的行为,造成他人身体健康严重伤害的,应当以故意伤害罪,过失致人重伤、死亡罪定罪处罚。Type research is essential to the criminal law analysis of doping behavior, and is the prerequisite for the realization of criminal behavior. The logic premise of accusation analysis has the correction function to the criminal legislation of doping behavior. Doping acts according to the violation of the legal interests, divided into violations of the socialist market economic order, damage to social management order, violations of civil rights and dereliction of duty category of doping behavior. First of all, doping violations of the order of the socialist market economy mainly for the production and sale of drugs on the doping behavior, can be handled in accordance with the production and sale of counterfeit crime, but taking into account the analogical interpretation of the suspects, shall promptly set up production and sales of drugs crime. Secondly, the doping behavior that hinders the social management order includes not only the crime of drugs, the obstruction of official duties, the provision of cheating equipment, but also the general illegal activities in the sports examination and competition. Finally, the violation of civil rights crime includes stimulant force, enticement, deception, threatening drug use stimulants, causing serious damage to the health of others, should be the crime of intentional injury, negligence causing serious injury, and even death conviction.
