论个人数据的使用、流通与监管

摘　　要：个人数据随着互联网技术发展而产生,现在已经逐渐成为信息化社会发展的一种基础资源和构成要素。而国内外不断发生的关于个人数据争议的案件促使个人数据立法制度也产生了相应变化。首先,个人数据的界定更加清晰明确,需要准确划分个人信息、个人数据与个人隐私的范围,并按个人数据敏感度分类保护。其次,个人数据的收集处理原则不断完善,以往个人数据收集的限制转为使用流通上的严格监管,质量保证也成为个人数据收集处理的重要原则。最后,还需要建立从个人数据的收集处理到跨境流通完整监管体系,并结合先进的技术手段提高监管效率。With the development of Internet technology, personal data has gradually become a ba sic resource and components of tlie development of information socie ty. Domestic and international cases of personal datadisputes have prompted corresponding changes in the legislation of personal data. First, the definition ofpersonal dat is clearer. Itisnecessary to accu rately classify the scope of personal informaand personal privacy. And class ify personal data though sen s itivity. Secondly, the princip le of personal datacollection and processing is constantly im proved, and the restriction of personal data collection to the use ofstrict supervision in circu lation, quality assu ran ce has also become an important principle of personal datacollection and procees ing. F ina l ly, we need to establish a complete supervision system from personal data collection to cross-border c ircu lation, and improve the efficiency of supervision by combining advanced technology.
