摘  要:我国宪法监督体制最早确立于1954年宪法,现行宪法对其进行了适度拓展。现行宪法确立的宪法监督体制存在许多问题,2000年《立法法》及其他相关法律文件对其进行了完善,但依然没有能够彻底解决我国宪法监督中存在的诸多问题。在现行宪法颁布实施前后,学界围绕宪法监督体制的健全与完善提出了种种设想,但最终均未被采纳。未来我国宪法监督体制的健全与完善应当立足于我国的根本政治制度,在人大制度的框架体系内加以健全与完善,建立以立法机关为主导、以司法机关为补充的宪法监督体制。对党内法规的宪法监督权应当由中共中央行使。In 1954, China established its system to supervise the constitution's implementation, which has been moderately revised in the current constitution. However, there are many problems with the current constitutional supervision system. Although some of them have been addressed in Legislation Law of the Peop to be le's Republic of China adopted in 2000, the deficiencies in the system of constitutional supervision remain overcome completely. After the adoption of the current constitution, legal scholars have proposed different solutions to the improvement of constitutional supervision, but their proposals have not been accepted. In the future, the improvement and perfection of the supervision system should be based on China's fundamental political system; that is, within the framework of People's Congress, we can build a constitutional supervision system where the legislative body plays the leading role and the judicial body performs a supporting role. The right to implement constitutional supervision over the internal rules and regulations of the CPC should he exercised by its Central Committee.
