摘　　要：网络直播打赏行为不是一般的赠与或附义务的赠与,打赏用户和网络主播之间存在新型服务合同关系。对于网络直播打赏是否可以撤销并追回的问题,应综合考量交易公平原则和交易安全原则,兼顾互联网经济的特性,根据打赏主体的民事行为能力以服务合同是否存在瑕疵综合判断。The online live reward is not a general gift or conditional gift, there is a new relationship of service contract between users and anchors. If the online live reward that can be withdrawn and recovered, we should comprehensively consider the principles of transaction fairness and transaction security, and take into account the characteristics of internet economy, according to comprehensive judge the civil action ability of subject in reward whether the design defects or anything which is not in conformity with the service contract.
