摘 要:刷单构成商业虚假宣传行为,是一种以广告之外形式进行的商业虚假宣传。刷单店家形象展示属于商业销售宣传,构成要约邀请。判断是否构成消法中的欺诈,要从消费者权益保护法的立法精神去分析。消法中的欺诈,需要在该商品的价格、质量、性能等一些实质性要素上有虚假陈述或重大隐瞒或误导才能构成。如果某商品的销售量、好评数是一个极其重要的考虑要素,足以误导一个正常理性的普通购买者在购买时作出决策,就可以认定为消法中的欺诈。刷单中,刷单人的参与将构成共同侵权责任。Scalping is a phenomenon in the networking of buying and selling behavior,which damage conventional market transactions.Scalping constitutes a commercial false propaganda.It is a commercial false propaganda in the form of advertising.The Scalping shop image display is a commercial sales promotion and constitutes an invitation to offer.To decide whether or not to constitute fraud in consumer law,we should analyze it from the sales behavior of scalping store and analyze it from the legislative spirit of consumer protection law.If a shopper wants to make a purchase decision,it is considered as a fraud in the consumer rights protection law that the sales and praise are very important factor,which is enough to mislead a normal purchaser to make a decision when buying it.
