摘　　要：发明构思来源于发明创造的过程,是发明人为解决现有技术问题所提出的技术改进思路或想法,因而更能体现发明的实质,在专利审查中得到越来越得到重视和广泛运用。本文围绕发明构思对创造性专利审查进行研究,进一步强化专利审查中证据支撑作用,有利于提高专利审查的效能。The invention concept is derived from the process of the creation. It is the technical improvement idea put forward by the inventor to solve the problems of the prior art. Therefore, it can better reflect the essence of the invention and has been paid more and more attention and widely used in patent examination. This paper studies the patent inventive around the concept of invention, further strengthens the evidence supporting role in patent examination, and is conducive to improving the effectiveness of patent examination.
