引渡基本原则在我国区际刑事司法协助中的适用——以港澳《关于移交被判刑人的安排》为视角

摘　　要：随着我国"两岸四地"间人员流动的更加方便快捷,跨越多个司法管辖区进行的犯罪行为也随之增多,而我国现阶段有关区际刑事司法协助的协议寥寥无几。其中,港澳间《关于移交被判刑人的安排》的达成与实施为我国尚处在讨论中的各区际刑事司法协助原则,尤其是"双重犯罪"与"本地居民不移交"两项原则的具体安排做出了弥足珍贵的指引。As the flow of people between China’ s cross-straits and four places, namely the inland, Taiwan,Hongkong and Macao, becomes more convenient and faster, the number of criminal activities across multiple juris-dictions has also increased. However, there are quite few agreements on inter-regional criminal justice assistance inChina at present. Among them, the completion and implementation of Arrangement on the Transfer of Sentenced Per-sons between Hong Kong and Macao bring valuable guidelines to the principle of inter-regional criminal justice as-sistance which is still under discussion in China, especially concerning the two principles in particular, namely,the principle of “dual criminality” and the principle of “not handing over local residents”.
