专家辅助人出庭质证的法律局限——对《最高人民法院关于审理医疗损害责任纠纷案件适用法律若干问题的解释》第十四条的分析

摘　　要：2017年12月14日《最高人民法院关于审理医疗损害责任纠纷案件适用法律若干问题的解释》颁布施行,对专家辅助人出庭质证范围、性质和作用进行了进一步明确。但比起鉴定人可以进行医疗损害鉴定的范围,专家辅助人的质证范围要小于鉴定人的鉴定范围。另外由于专家辅助人与鉴定人意见并未单独作为证人证言中的意见证据,而是归类于鉴定意见和当事人陈述,所以受到证据属性的影响,专家辅助人可能无法在法庭上充分发表意见证据并受到事实裁判者采纳。On December 14,2017,the Interpretation of the Supreme People′s Court on several issues concerning the application of law in the case of liability disputes for medical damages enacted,appear in court to expert auxiliary cross-examination scope,nature and made further clear.But compared with surveyor can carry out the scope of the medical damage identification,the expert auxiliary person′s quality certificate scope should be less than the identification scope of the surveyor.In addition by expert auxiliary and surveyor opinion is not alone as opinion evidence in the testimony of witnesses,but classified as appraisal opinions and statements,the parties so affected by attributes of the evidence,expert auxiliary people may not be able to fully opinion evidence in the court and judge adopted by facts.
