精神病司法鉴定的退鉴情况分析

摘　　要：目的对精神病司法鉴定的退鉴情况进行分析。方法回顾性分析首都医科大学附属北京安定医院精神疾病司法鉴定科2013年至2016年间的96例退鉴案例。分析指标主要包括:鉴定类别、鉴定事项、退鉴原因。结果 (1)4年间退鉴数量的绝对值和构成比均呈增加的趋势;(2)退鉴案例以民事司法精神病鉴定为主(88.5%,85/96);(3)退鉴事项主要是广义的民事行为能力、对特定的民事事务的行为能力、诉讼能力;(4)退鉴原因主要是"被鉴定人拒不配合或者鉴定活动受到严重干扰"(43.8%,42/96)和"鉴定材料不真实、不完整、不充分"(33.3%,32/96)。结论精神病司法鉴定退鉴数量趋于增多,其中以民事司法精神病鉴定为主,退鉴原因主要是当事人不配合及鉴定材料不够完整、充分。建议委托人在鉴定前与鉴定人和当事人进行必要的沟通,以保证鉴定活动顺利开展。Objective To analyze the withdrawal of psychiatric expertise.Methods A retrospective analysis of 96 cases of withdrawal from 2013 to 2016 in psychiatric department of Beijing Anding Hospital affiliated to Capital Medical University was conducted.The analysis indexes include identification category,identification items and reasons.Results（1） in the 4 years,the absolute value and constituent ratio of the amount of withdrawal were increasing.（2） the case of withdrawal of cases is mainly based on the identification of civil judicial psychiatry（88.5%,85/96）.（3） withdrawal of reference matters mainly include broad sense capacity for civil conduct,capacity for specific civil affairs and litigation capacity.（4） the reasons for the withdrawal of the investigation are mainly：＂the rejected person does not cooperate or the identification activities are seriously disturbed＂（43.8%,42/96） and the identification material is untrue,incomplete and inadequate（33.3%,32/96）.Conclusion The number of withdrawal of psychiatric judicial expertise tends to increase,among which the identification of civil judicial psychiatry is the main one,and the reasons for the withdrawal are mainly that the parties do not cooperate and the identification materials are not complete and sufficient.It is recommended that the client conduct necessary communication with the appraiser and the parties before the identification so as to ensure the smooth development of the appraisal activities.
