法律电影视域下的中西民众诉讼心理比较研究——以《我不是潘金莲》和《费城故事》为例

摘　　要：优秀的法律电影是一国法律文化的标本,足以反映一国的诉讼文化及诉讼心理。通过经典法律电影所折射出的中国民众的厌讼心理与西方民众的好讼心理之比较,我们获得了三点启示,分别是:法治的实现离不开良法善治,同时也要重视法律之外的纠纷解决方式;法治的认同需要深化民众的法律信仰、树立法律权威;法治的进步需要借助法治教育来培育广大民众的公民意识、法治意识、权利意识。Excellent legal film is a specimen of a country＇s legal culture,which can reflect a country＇s litigation culture and litigation psychology.Through the comparison between the Chinese people＇s litigious psychology and the western people＇s psychology of＂weary of litigation＂via the classic legal film,we have gained three inspirations,namely：Firstly,the realization of the rule of law can＇t be separated from good law and good governance;at the same time,we should attach importance to the solution of disputes outside the law.Next,the identification of the rule of law needs to deepen people＇s legal faith and establish legal authority.Finally,the progress of the rule of law requires use of the rule of law education to cultivate citizens＇ consciousness,the rule of law consciousness and right consciousness.
