国家人权行动规范的牵引力与推动力

摘　　要：第一期《国家人权行动计划(2009—2010年)》第二部分"公民权利与政治权利保障"共涉及了八项权利,与刑事诉讼法落实有着紧密关系的是前三项权利——人身权、被羁押者权与获得公正审判权,其文本约2000余字,共22条。第二期《国家人权行动计划(2012—2015年)》这三项权利的结构相同,也有22条,约1700余字。第三期《国家人权行动计划(2016—2020年)》将第二项权利吸收进了第一项,共25条,约1500余字。它们均在相应的时段成为了落实这些权利的政策性、牵引性甚至强制性的规范,已具备了较强的法律规范效力,应被界定为"行动规范"。通过对它们的类型化分析,能发现其文本制定上的可取与不足之处。这三期《国家人权行动计划》实施九年来,这几项重要权利的保障取得了不少成绩,彰显了人权行动的政府与国家责任、人权行动需尊重本国现实与主权而渐进推行的重要性。同时,其实施也反映了那些经常侵犯公民权利行为的顽固性。而对此的原因分析,有利于揭示下一期《国家人权行动计划》的草拟重点与行动要点。＂Civil and Political Rights＂,the second part of the first issue of the National Human Rights Action Plan of China（ 2009-2010）（ hereinafter referred to as the Action Plan）,involves eight rights,among which the first three rights—rights of the person,rights of detainees and right to fair trial—are closely related to the implementation of The Criminal Procedure Law. The text is about 2 000 words with a total of 22 articles.These three items of rights in the second issue of the Action Plan（ 2012-2015） are arranged in the same text,which is about 1 700 words,with 22 terms totally. The rights of detainees is integrated into the rights of the third issue of the Action Plan（ 2016-2020）,in which there are 25 articles in all with about 1 500 words. All of them should be defined ＂action codes＂,for they have become policy,traction and even mandatory rules for the implementation of these rights in the corresponding time period,followed by stronger normative legal effects. Typological analysis can be helpful to find the merits and deficiencies in clause formulation of these rights. In the past nine years,achievements have been made in the protection of these important rights,highlighting the responsibility of the government and state in human rights actions and the importance of human rights actions that respects domestic realities and sovereignty in the gradual implementation. Meanwhile,the implementation of the Action Plan reflects the intransigence of those who violate civil rights. The analysis will help reveal the drafting priorities and action points of the next issue of the National Human Rights Action Plan of China.
