“基层群众性自治组织”参与模式的法律机理及实践路径——兼评田兴洪教授新著《社区矫正中的社区参与模式研究》

摘　　要：社区矫正中的社区参与模式由本体结构、行动过程及环境嵌入三个部分组成。其中,本体结构是对参与模式本身内涵外延及结构特征的描述,属于内部、静态层面;行动过程是对参与模式运行机理、运行程序、运行平台及运行方法等功能发挥和作用彰显过程的揭示,属于过程、动态层面;环境嵌入则是对参与模式正常运行所需社会环境和保障条件的刻画,属于外部、互动层面。我国社区矫正中的参与模式的优化思路在于构建"基层群众性自治组织"参与模式以取代现行"2+N"参与模式。Community participation pattern in community correction consists of three parts that ontology structure, action process, and environment embedding. Among them, the ontology structure is the description of the extensive connotation and structural characteristics of the participation pattern, which belongs to the internal and static level. The action process is the reveal of the functioning of the operation mechanisms, operation procedures, operation platforms and operation methods of the participation pattern, which belongs to the procedural and dynamic level. The en vironment embedding is the description of the social environment and security conditions needed for the normal operation of the participation pattern, which belongs to the external and interactive level. The optimization of the participa tion pattern in community correction in China lies in the replacement of current pattern of ＂2＋N＂ with the pattern of ＂grass- roots mass self- government organizations＂.
