人民检察院提起环境公益诉讼制度之完善

摘　　要：环境污染、生态破坏问题日渐突出,检察院提起环境公益诉讼制度具有正当性。但检察院法律监督职能与其环境公益诉讼原告身份存在冲突,检察院提起环境公益诉讼并无具体可操作的程序,检察院提起民事环境公益诉讼与行政机关职能出现重叠,检察院提起环境公益诉讼对象与法院规定的检察院提起环境公益诉讼对象之间存在矛盾。完善检察院提起环境公益诉讼制度,需要制定配套的法律,建立专门的环境公益诉讼审判机关,提高检察院提起环境公益诉讼级别,形成行政机关保护为主、检察院保护为辅的环境保护体系。The problem of environmental pollution and ecological destruction is becoming more and more prominent. The procuratorate has brought about the legitimacy of the environmental public interest litigation system, but there is a conflict between the legal supervision function of the procuratorate and the identity of the plaintiff in the environmental public interest litigation. The procuratorate has no specific procedures to initiate environmental public interest litigation, and the inspection institute brings up civil environment public interest litigation and action. The overlapping of the functions of the government organs, there is a contradiction between the object of the Procuratorate＇ s environmental public interest litigation and the object of environmental public interest litigation filed by the procuratorate stipulated by the court. In order to improve the Procuratorate＇ s environmental public interest litigation system, it is necessary to formulate relevant laws, establish special environmental public interest litigation trial organs, raise the level of procuratorate to bring environmental public interest litigation, and form the environmental protection system which is the main protection of the administrative organs and the protection of the procuratorate.
