摘 要:《民办教育促进法》的修订是法律制度与政策行动互动的结果。运用多源流理论分析《民办教育促进法》修订的政策过程,不仅有助于揭示民办教育法律关系的特点与本质,而且有助于建构具有中国特色的教育决策理论。发展之困、规则含混与法律冲突构成问题流,分类管理的政策分歧与修法建议构成政策流,政府话语和公众反馈的相互影响构成政治流,三流交汇推开了《民办教育促进法》修订的政策之窗,体现出复杂决策场域之下的修法进程。"三源流"的反复动态嵌套,表征我国教育修法正朝着"科学"与"民主"迈进。《民办教育促进法》修订的政策过程展现出的动态嵌套的"多源流理论",在教育立法和修法中具有重要的政策价值。Revision of "Private Education Promotion Law" is the result of interaction between legal system and policy action. Not only does analysis on policy process of "private education promotion law"revision using multiple-streams help to reveal the characteristics and nature of legal relationship in private education, but also contributes to construction of education decision theory with Chinese characteristics. Development dilemma, ambiguity of rules and law conflicts constitute problems stream, policy disagreements and law revision recommendations on classified management constitute policy stream, the mutual influence of government discourse and public feedback constitutes political stream, three-fluid coupling opens the policy window of "private education promotion law" revision, reflects the law revision processes under complex field of decision-making. Repeated dynamic nesting of "three streams" is the representation that revision of education law is moving towards "science" and "democracy" in China. The policy process off'Private Education Promotion Law" revision shows dynamic nested "theo.ry of multiple streams", which has important policy value in making and revising education law.
