摘　　要：不同社会发展时期需要不同的社会管理方式。社会管理的基本途径是依据社会规则保障国民利益,即依＂法＂治国。法律是社会管理手段体系中的核心部分,法治国家要求社会治理规则保障国民最大限度的自由与利益。刑法防治犯罪与保障人权之机能与法治精神高度契合。在社会管理创新的时代背景和要求下,刑事法律如何更好地发挥社会矛盾调整的最后手段之作用,是决定法律制度体系整体社会管理能力优劣的关键。以促进社会和谐及保障人权为前提,刑事法治在社会管理过程中,对于诸如闹访现象、未成年人的保护和社区矫正等新时期社会突出矛盾的调整和问题的解决应及时作出适当的抉择与反映,以充分且恰当地体现并满足社会管理创新的宗旨和要求。Different social development needs different social management. The basic way of social management is to protect national interests according to social rules, which can also called governing the country according to law. Law is the core part of the system of social management means, the rule of law requires social governance rules to protect the maximum freedom and interests of the people. The function of criminal law of preventing and controlling crime and protecting human rights fits completely the spirit of rule of law. Under the background and the requirements of social management innovation, how the criminal law can better play the role of the final means of social contradictions adjustment is the key to determine the quality of the overall social management system of the legal system. By promotion social harmony and the protection of human rights as the premise, the criminal law in the process of social management, to solve the trouble such as the protection of minors and the phenomenon of community correction social contradictions and problems should be adjusted to make appropriate choices and reflect,to fully and appropriately embody and satisfy the purpose and requirements of the social management innovation.
