网络犯罪魔变中的刑法理性检讨——网络刑法理论研究的现状观察与观点综述

摘　　要：现代信息技术的发展导致了网络刑法理论的变异,需要在检讨刑法理性的基础上对魔变后的网络犯罪进行新诠释。网络犯罪是利用计算机信息技术和设备,借助于互联网对其系统或信息进行攻击,以及以网络技术为工具或者以网络为犯罪空间所实施的犯罪。运用＂帮助行为正犯化＂＂预备行为实行化＂＂行为主体聚合化＂等理论工具,可以较为合理地解决诸如网络犯罪的＂资助＂行为、网络恐怖主义犯罪以及网络平台服务提供者的责任等理论和实务问题。通过对国内外关于网络犯罪立法和司法的考察,法理上有较为充足的根据进一步完善将网络犯罪＂资助＂行为单独入罪化、完善＂工具型＂和＂目标型＂网络恐怖主义犯罪的规制以及承认网络平台的＂过失责任＂、确定＂情节严重＂的客观标准和建立网络附加刑这一立法远景。The development of modern information technology has led to the variation of cybercrime theory, in need of using the criminal law reason to interpret the magically changing cybercrime in a new way. Cybercrime are actions conducted by using computer information technology and equipment, attacking its system or information by means of the Internet, or using network technology as tools, or using network as crime spaces;Through making use of the theoretical tools of＂ assisting in the act of committing crimes carrying out preparatory actions＂ and ＂aggregating behavioral actors＂, we can solve the problems of＂ subsidy＂ acts, cyber terrorism crime and the responsibility of the network platform service provider relatively rationally. Through the investigation of the domestic and foreign legislation and judicial investigation on cybercrime, the author points out the legislative vision with relatively enough theoretical support that put the cybercrime＂ subsidy＂ acts into the crime separately, and perfect the regulation towards ＂ tool＂ and ＂ target＂ cyber terrorism crime, and recognize the ＂ fault liability＂ of network platform services providers and determine the objective criteria of the ＂ serious circumstances＂, and establish the cyber accessory punishment.
