摘 要:我国每年机动车交通事故数量庞大,伤者众多,予以充分救济显得尤为重要。机动车交通事故伤者的救济机制,主要由机动车交通事故责任强制保险赔偿、侵权人赔偿与道路交通事故社会救助基金垫付三部分组成。然而该机制中的机动车交通事故责任强制保险与道路交通事故社会救助基金不同程度地存在一些问题。机动车交通事故责任强制保险不恰当地分项设置赔偿限额,且赔偿限额偏低;赔偿财产损失,削弱了交强险的救助功能等。道路交通事故社会救助基金结余量大、使用率总体偏低;救助覆盖面非常小,仅限于丧葬费或抢救费用;救助基金难申请、难获得现象较为普遍。A large number of vehicle traffic accidents and a large number of injuries happen in China every year and it is particularly important to give adequate relief. The relief mechanism for vehicle traffic accident victims consists of three parts: the mandatory motor vehicle traffic liability insurance, the compensation from infringer and social salvation fund in road traffic accident. However, both the mandatory motor vehicle traffic liability insurance and social salvation fund in road traffic accident have some problems. The mandatory motor vehicle traffic liability insurance is improperly itemized and the limitation of compensation is relatively low And its compensation to property loss weakens its rescue function. Social salvation fund in road traffic accident is low in rate of utilization and its aid coverage is very narrow, limited to funeral or rescue expenses and it is difficult to apply for and obtain.
