摘　　要：目前在我国,行政罚款基本做到有法可依、有章可循,但在罚款数额设定上还不同程度存在任意性,"过罚不当"现象大量存在。针对现实中存在的"过罚不当"问题,基于经营者利益与公众利益实现适度平衡的理念,给出一种确定行政罚款数额的新方法,以期为维护法治秩序、规制行政罚款及引导经营性行为提供些许智力支持。At present,the administrative money penalty is basically made according to the laws and rules in our country.But there is still different degrees of arbitrariness in the setting of fining amount,and phenomena of ＂fault not equal to punishment＂ is existing in large quantities.This paper,basing on the idea of realizing the appropriate balance between the interests of the operators and the public,gives a new method to determine the amount of the administrative money penalty.We wish it could provide some intellectual support for maintaining the order of the rule of law,regulating administrative money penalty and guiding business conducts.
