金融禀赋结构理论下金融法基本理念和基本原则的革新

摘　　要：金融禀赋结构理论认为,反映实体经济要素禀赋的最优金融结构是金融发展的核心中间变量。只有实际金融结构与最优金融结构相符,金融体系的功能方能实现最大化。为此,金融法必须恪守最优金融结构理念,将最优金融结构作为引导金融立法和金融法律运行的指挥棒和试金石。最优金融结构理念在金融法原则上的映射是金融市场优先原则,要求国家在进行金融宏观调控和金融监管的过程中,将金融结构作为调控和监管的中介目标,保持对金融市场机制的充分尊重和敬畏,自觉维护和保障金融市场最优金融结构,以达到国家对金融市场的最优干预绩效。金融市场优先原则包含金融市场干预比例原则、金融市场理性假定原则和金融调制综合协调原则等三大子原则。On the basis of financial endowment structure theory, the optimal financial structure which reflects the real economy factor endowment is the core variables of the financial development. Only when the actual financial structure con- form to the optimal financial structure, the function of the financial system could be maximization. Therefore, financial law must abide by the optimal financial structure concept, worship the optimal financial structure as the baton and touchstone of financial legislation and financial law operation. The optimal financial structure concept mapping in the principle of finan- cial law is the priority principle of financial markets, it requires countries put financial structure as a intermediary target of financial macro - control and financial regulation, keep fully respect and awe of the financial market mechanism, conscious- ly maintenance and guarantee the optimal financial structure, in order to achieve the optimal intervention performance in the financial market. Financial markets priority principle including three subsequent principles： proportion principle of finan- cial market intervention, rational assumption principle of financial markets and comprehensive coordination principle of fi- nancial markets macro- control and regulation.
