民族地区立法司法相结合的法律变通机制构建

摘　　要：民族地区的法律变通既有法律依据也有客观依据,法律变通的最终实施目的是让民族地区的法律实施更加切合民族地区的实际情况,推进民族地区的法制建设。因此,民族地区的法律变通是必要的也是可行的。要使民族地区的法律变通充分发挥作用,就必须建构立法和司法相结合的法律变通机制,以立法变通和司法变通在理念、基础、范围、原则等方面的统一,促成两者在法律层面上的协调一致。同时也要形成立法变通和司法变通的制度规定,使民族地区的法律变通获得制度保障,有序运作,最终以法律变通机制的建构彰显民族地区法律变通的正当性、合理性和有效性。The adaptation of laws in ethnic minority areas has both legal and objective bases,and the ultimate implementation of legal modifications is to make the implementation of laws in minority areas more consistent with the actual situation in ethnic areas.Therefore,it is necessary and feasible to improve the legal system in ethnic minority areas.In order to make the legal modifications in minority areas fully play their role,it is necessary to construct a legal adaptation mechanism that combines legislation with justice.The unification of concept,foundation,scope,principle and so on by legislative adaptation and judicial adaptation,which promotes the coordination of the two at the legal level,and at the same time forms the system of legislative adaptation and judicial adaptation.Finally,the construction of the legal adaptation mechanism of the minority areas will demonstrate the legitimacy,rationality and effectiveness of the legal adaptation in the minority areas.
