论民族区域自治制度宪法执行机制之完善

摘　　要：民族区域自治制度是解决中国民族问题的基本政治制度。随着"中华民族伟大复兴"入宪,民族区域自治制度的宪法执行机制也应进行相应完善。宪法执行机制是宪法实施的重要构成部分,民族区域自治制度宪法执行机制完善必须以"中华民族"入宪和解决民族问题的宪法原则为基础,将"中华民族"范畴和解决民族问题的宪法原则具体化,完善民族区域自治制度的相关法律体系。在主体范畴方面,将"中华民族""五十六个民族""中华民族伟大复兴"和"民族事务法治化"等宪法主体纳入《民族区域自治法》,并完善民族自治权依法行使的范围和程序建设,从而为解决中国民族问题提供根本法治化路径。The System of Regional Autonomy of Ethnic Minorities is the basic political system to solve our national problems. With the ＂the great rejuvenation of the Chinese nation＂ into the constitution, the constitutional implementation mechanism of the System of Regional Autonomy of Ethnic Minorities should be improved accordingly. The implementation mechanism of constitution is an important component of the enforeement of constitution. The perfection of the constitutional implementation mechanism of the System of Regional Autonomy of Ethnic： Minorities must be based on the constitutional principle of ＂Chinese nation＂ entering the constitution and solving national problems. The eategory of ＂Chinese nation＂ and the constitutional principle of solving ethnic： problems shouht be concretized, and the legal system relevant to the System of Regional Autonomy of Ethnic： Minorities shouht be perected. In temps of subject eategory, the state must bring the ＂Chinese nation＂, ＂Fifty-six nationalities＂, ＂the great rejuvenation of the Chinese nation＂ and ＂legalization of national atfairs＂ into the Law on Regional Autonomy of Ethnic Minorities. The scope and procedure must be improved tbr the autonomy right in accordance with the law. Thus, it provides a fundamental path of rule of law tbr sol- ving the ethnic： problems in China.
