摘 要:中国船舶油污损害赔偿基金已正式开始理赔,相关法律实践问题亟需完善。通过案例从法院裁判与基金理赔的不同认定、实践问题两个角度探析船舶油污损害的不同赔偿层次,区分与识别各自实践中的不同实体与程序问题,协调二者间的承启关系,通过提出应对不同程序所应采取的适当申请,提升理赔实践效率,促进完善理赔法律逻辑。Chinese Ship-source Oil Pollution Compensation Fund has started claim settlement so it is in urgent need to solve problems existing in law practices. By case study,this paper explores different levels of compensation for oil population damage from ships from the perspective of different judgments made by court and Fund for claim settlement as well as that of practical problems,distinguishes and recognizes different entities and procedures in respective practices,coordinates the progressive relationship between the two,and proposes corresponding application method for different procedures to increase the efficiency of claim settlement and promote the perfection of legal logic of claim settlement.
