摘　　要：串通投标,犹如过街老鼠,人人喊打,不管是法律、法规,还是国家有关各种文件,均一而再、再而三地强调对此的打击,甚至还将串通投标入刑,行为恶劣到一定程度,除追究民事责任、行政责任外,还可以追究刑事责任。如此高压,看似360度全方位约束,但在实际工作中,却遇到一个难题,即:存在串标的投标人,其投标保证金可否不予退还?本文从一个案例出发,从法律、法规以及标准招标文件等角度予以分析,并提出相应的法规完善建议和具体处理措施。Collusion, is like a rat crossing the street, everyone Shouting dozen, whether it＇s laws and regulations and relevant state documents of all sorts, both has repeatedly stressed to blow, even will submit tenders in collusion with punishment, bad behavior to a certain extent, except for civil responsibility, administrative responsibility, and can also be investigated for criminal responsibility according to law so high pressure, seemingly 360 - degree constraint, but in practice, has encountered a problem, i.e., the existing string re-bid, can its bid bond will not be returned？ Based on a case, this paper analyzes the laws and regulations, standard bidding documents and other aspects, and puts forward corresponding Suggestions and specific measures to improve the regulations.
