摘　　要：从当前检察机关自侦案件中采用技侦措施的适用依据、操作程序、运行状况、存在问题等角度,分析职务犯罪中技侦获取的材料较少、直接作为证据和技侦功能无法充分发挥的原因,并提出了完善技侦程序适用的立法建议,包括明确适用案件范围标准、细化适用对象及条件、确定审批主体和执行主体、严格审批程序及实施期限、完善监督机制和建立救济程序等对策。This article mainly recommends the technical investigation measures adopted by the procuratorial organs in the current self-investigation cases, which introduced from the perspective of the applicable cases, operation procedure, operation status, and the existing problems. Then the paper tries to analyze the reasons why the technical investigation in duty crimes has less materials and cannot be fully used directly in evidence, and the reason why the technical detection function cannot be fully utilized. This article also proposes legislative proposals to improve the application of technical investigation procedures, including clarifying the scope and standards of the applicable cases, refining the applicable objects and conditions, determining the subject of examination and approval and the subject of execution, strictly examining and approving procedures and the implementation period, improving the supervision mechanism, and establishing relief procedures and so on.
