高校毕业生创业的法律保障机制研究

摘　　要：高校毕业生在创业组织设定、运营和终止过程中都面临着各种法律风险,但是他们缺乏对创业法律风险的认识,防控风险的能力不足,以致于创业成功率低。此外,国家关于创业法律保障方面也存在立法层级低且多为政策性规定、创业法律教育有所缺失、创业相关法律不完善等诸多问题。因此,当前必须从化解创业法律风险、加强创业立法、完善创业法律教育模式、完善金融法和财税法等方面构建促进高校毕业生创业的法律保障机制。In the process of entrepreneurial organization, operation and termination, university graduates are faced with all kinds of legal risks, but their lack of knowledge about business legal risk and ability to prevent and control risk lead to the low rate of entrepreneurial success. In addition, there are many problems in the state＇s law guaranteeing of entrepreneurship, such as low level of legislation with most being policy provisions, lack of entrepreneurship law education and imperfect laws related to entrepreneurship. Therefore, currently, the legal safeguard mechanism must be built to promote university graduates entrepreneurship from resolving business legal risk, strengthening the pioneering legislation, perfecting the legal education mode, perfecting the financial law and tax law and so on.
