党政机构统筹改革与行政法理论的发展

摘　　要：党政机构统筹设置使党政关系的探索进入了新阶段。在党政机构合并设立或合署办公的背景下,不仅党政机构融合,而且党务政务融合,法治监督体系和责任体系融合,导致了行政法的基本原则、行政法的渊源、行政主体理论、行政行为与行政程序制度、行政法治监督体系以及行政救济理论等一系列行政法的基本理论的变迁。党的全面领导成为行政法的基本原则,党内法规成为行政法的法源,行政决策、政务公开与党的决策、党务公开结合在一起,行政内部监督体系上升为党和国家监督体系。新时代党政统筹改革背景下需要对行政法基本理论进行重构。The party and government organs have been co-ordinated,and the exploration of partygovernment relationship has entered a new stage. Under the background of the merger or co-working of the party and government organs,both the party and government organs and their respective affairs have integrated,as well as their respective law supervision system and responsibility system. As a result,a series of fundamental theories of administrative law have evolved,such as the basic principles of administrative law,the origin of administrative law,the theory of administrative subjects,administrative behavior and administrative procedure system,legal supervision system upon administration and administrative remedy theory. The party＇ s overall leadership has become the basic principle of administrative law. The party＇ s internal regulations have become the legal source of administrative law. Administrative decision-making is combined with party decision-making and party affairs; publicity of government affairs is combined with the publicity of party affairs. And the internal administrative supervision system has risen to the party and state supervision system. Under the background of the reform of the party and government in the new era,it is necessary to reconstruct the basic theory of administrative law.
