摘　　要：在全面依法治国背景下,基本医疗保险如何步入法制轨道的问题,重要性与紧迫性日益显现。基本医疗保险立法进程宜加快,但前景任重道远;医保的制度完善与运行,需要更加有效、有序的公众参与,且应全方位考虑特殊群体的需求;执法监管作为薄弱环节,需要标本兼治,一方面通过专项执法、联合执法与两法衔接,增加执法密度、强度与精度,另一方面用好信息化、大数据与公开公示机制,完善预防预警和监控体系,从源头减少违法发生;基本医疗保险领域的纠纷风险不容低估,纠纷化解系衡量治理能力的重要指标,完善医保诉讼制度并激活公益诉讼制度。In the background of comprehensively implement the rule of law, basic medical insurance system faces severe challenges. Firstly, the legislation process should be accelerated, however its future is not optimistic. Secondly, basic medical insurance system needs more e？ ective public participation, which should take the special group into account. Thirdly, enforcement and supervision as the weak link, should addresse both the symptoms and root cause. Fourthly, dispute risk should not to be underestimated, and dispute resolution capability is the key indicator.【
