福利多元主义视角下社区戒毒制度的反思与改良

摘　　要：社区戒毒相对于强制隔离戒毒的"惩罚性"而言是一种"社会性"的福利制度,但在合理性、戒毒效果评估等方面还存在诸多缺陷,在实践运行中还存在"行政化主导""缺乏社会力量民主参与"等问题。应结合社区戒毒现状,将社区戒毒的力量下放到基层,放开社会组织的民主化参与,规范进入门槛,引入第三方诊断评估机制等,完善社区戒毒制度,达到"帮助戒毒人员戒除毒瘾、顺利回归社会"的立法目的。Community drug rehabilitation is a social welfare system in the case of punitiveness of the compulsory isolation for drug rehabilitation, which still witnesses a number of defects in terms of rationality and effectiveness evaluation, and administrative dominance and lack of social forces＇ democratic participation in practical operation.Accordingly, efforts need to be made to combine the current conditions of community drug rehabilitation, decentralize power of community drug rehabilitation to the grass roots, clear away the threshold for democratic participation of social organizations, introduce the third party＇s diagnostic evaluation mechanism, and improve community drug rehabilitation system, so as to achieve the legal objective of assisting the drug addicts in their drug rehabilitation.
