摘 要:国家监察体制改革实现了党对反腐败工作的集中统一领导,深入推动了国家治理的现代化。但是,本次改革对检察机关反贪反渎职能的剥离客观上有可能减弱检察权威,给尚不成熟的行政公益诉讼带来挑战,使检察机关对行政机关违法失职行为的监督和调查更为不易。这就要求行政公益诉讼必须重构当前的制度模式,与监察体制改革实现有效的协调衔接。当前可与国家监察机关建立贯穿行政公益诉讼全过程的协同联动机制,形成保护公益的强大合力;将来可以探索建立由监察机关作为专门调查机关,检察机关作为专门起诉机关,法院作为专门审理机关,三者分工负责、相互配合、相互制约的"调查—起诉—审理"分立的科学模式。The Party has centralized the leadership of the anti-corruption work and pushed the Modernization of national governance deeply by reforming the national supervision system. Then the procuratorate's anti-corruption function has been deprived, bringings more challenge to the immature administrative public interest litigation. The reduction of the procuratorate's function and authority will make it even more difficult for the prosecutors to monitor and investigate illegal administration.Therefore, it is necessary to reconstruct the model of administrative public interest litigation by coordinating with the supervision system. In the near future, the administrative public interest litigation should coordinate with the supervision system and establish a scientific "Investigation—Prosecution—Trail" model, in which the supervisory will be in charge of investigation, the procuratorate in charge of prosecution, and the court in charge of trail and the three coordinate and restrict each other.
