摘 要:台湾地区制订了法官多元进用的完美制度文本,进用对象广泛、条件多样、方式灵活、程序规范,但实践运行效果与期待不符。这说明制度转轨要与司法整体配套条件进行同步规划,要解决新旧人之间的晋升之争,解决提高待遇的内部诉求与提升司法水平的外部压力之间的冲突等问题。大陆应借鉴台湾经验,把政策目标转换成精细的制度文本,实现法官任用制度的适度转轨,为高阶法院选拔高阶专才,建立独特的法官晋升体系,完善不适任法官的淘汰机制。Taiwan has drawn up a perfect system text of law for the pluralistic recruitment of judges in Taiwan with its target candidates from various background, different qualifications, flexible selection system and standardized procedure. However, the practical effect is not in accordance with expectation. This indicates that the system transition should be planned synchronously with the overall supporting conditions of the judiciary so as to solve the dispute of promotion between the old and the new and the conflict between the internal demands of the treatment improvement and the external pressure of the judicial level improvement. This paper argues that the mainland should draw lessons from Taiwan experience to transform the policy objective into a fine system text, realize the moderate transition of the appointment system of judges and select high-level professionals for higher courts. On the other hand, it should also establish a unique system for the promotion of judges and perfect the mechanism for the elimination of the unaualified.
