数字环境下美国版权法对图书馆例外保护的变革——第108条修订案征求意见稿的解读与启示

摘　　要：美国版权法第108条是专门对图书馆等公共机构复制、传播、提供资源利用服务等进行例外保护的法律,但在数字环境中出现了明显的不适用性。美国版权局最新公布的第108条修订案征求意见稿,集成了过去10年美国图书馆领域对数字版权问题的研究成果与应对方案。第108条的修订过程与结果反映了数字环境下图书馆例外保护面临的变革,提供了美国版权立法领域给出的解决方案,为我国未来关于数字环境下图书馆版权例外保护的立法修订提供了借鉴。The Section 108 of the Copyright Act of U. S. shows the limitations on the rights of reputation and distribution of libraries and other public institutions. However, there is a marked inapplicability for it in the digital environment. The discussion document of the Section 108 issued by the Copyright Office integrates the research results and practical solutions on digital issues in the library field in the past decade. The revision process and results reflect the big change of library copyright exception protection in digital age, as well as the positive feedback from the copyright legislation. Therefore, it can be used as reference for the future legislative revision in China for library copyright exception protection in digital environment.
