摘  要:本文从中国—东盟自贸区设立背景入手,用国际关系学与法学双重视角对CAFTA争端解决的机制的意义进行阐释,认为应将CAFTA争端解决的机制区分为机制内外,进一步又区分为法律性与非法律性的、政府性与民间性的等多个种类。对CAFTA内部争端解决机制深入研究,指出其存在的不足并有针对性地提出完善建议;综合各种解决争端的法律方法,营造一个良好的法治环境,实现抽象性的国际争端解决机制有效地在中国与东盟各国之间相互经贸往来的实践中得到落实,以CAFTA推动区域经济一体化进程,也为建设相互尊重、公平正义、合作共赢的新型争端解决的机制提供有力的借鉴和参考。Combining with the building background and process of CAFTA, this article attempts to illustrate the establishment and significance of ASEAN economic and trade dispute settlement mechanism from the perspective of international relations and law. CAFTA dispute settlement mechanism should be divided into internal and external parts, which is also classified imo governmental, non-governmental and judicial types. The in-depth study on the internal dispute settlement mechanism of CAFTA shows its shortcomings and gives suggestions for further improvement. By combining various legal ways, a sound environment can be created to help it solve the disputes arising in the course of CAFTA easily. Besides, it can promote the economic and trade exchanges between China and ASEAN countries, and also improve the effectiveness of the international dispute settlement mechanism as an abstract system. By doing this, it achieves the purpose of maintaining regional stability and promoting economic development. It also provides reference for building a new kind of mutual respect, justice, cooperation and win-win dispute settlement mechanism.
