邮轮旅游本土化进程法律协调之困与因应选择

摘　　要：在邮轮旅游本土化的进程中,由于"无法可依"与"有法难依"的法律现实,产生了邮轮旅游旅行社代理模式异化、邮轮旅游船客利益失衡及邮轮旅游纠纷执法困境的法律协调难题。在法律规则冲突背景下,邮轮旅游双重管理体制与产业安全协调下的"包船游""切舱"模式衍生,"契约自由"原则彰显了与"中国式维权"的冲突,船旗国管辖与港口管辖权存在执法边界障碍与政治维稳博弈难题。对此法律协调困境因应选择路径在于以《海商法》立法修改的立法视角及行政管理的管理角度修正现有旅行社代理模式的缺陷,构建非诉机制的实体救济与邮轮母港管辖权的程序性救济机制矫正邮轮旅游船客利益失衡问题,建构谅解备忘录制度与邮轮口岸管理诚信体系并向破解邮轮旅游执法困境。In the process of localization of cruise tourism,due to the legal reality of ＂no law can be relied upon＂and ＂difficult to rely on law＂,the legal coordination problem of the alienation of the agency model of cruise travel agency,the unbalanced interests of cruise ship cruisers and the law enforcement dilemma of cruise tourism disputes has arisen. Under the background of conflicts of laws and regulations,the＂charter tour＂and＂cutting cabin＂modes under the coordination of the dual management system of cruise tourism and industrial security are derived,and the principle of ＂freedom of contract＂highlights the conflict with ＂Chinese-style rights protection＂.In addition,the obstacles to the enforcement of borders between the jurisdiction of the flag state and the port challenges political stability. The solution to the legal coordination dilemma depends on the legislative perspective of the revision of the legislation of the Maritime Law and the administrative management perspective to correct the defects of the existing travel agency model,the establishment of the non-litigation mechanism of the entity relief and the procedural relief mechanism of the cruise ship＇s jurisdiction to correct the unbalanced interests of cruisers. Moreover,construct a memorandum of understanding system and a cruise port management credit system to solve the problem of cruise travel law enforcement.
