摘　　要：在"自由给安全让路"的观念深入人心的当代社会,立法上的谦抑主义必将遭遇一定程度的消减,从而导致犯罪圈不断扩张。刑法谦抑主义消减的必然性深刻植根于刑法的发展趋势之中,具体表现为法益保护的前置化和统制管理功能的多用化。刑法谦抑主义消减的后果并非是消极的,既不会危及法治人权,也不会破坏我国二元制的立法体制。The concept of ＂Trading Freedom for Security＂is deeply rooted in contemporary society and the modesty principle of criminal law would be some degree of recessive,which leads to the further expansion of the crime circle. The recession of modesty principle of criminal law deeply rooted in the inevitability of the development trend of criminal law,reflected as the preprotection of legal interest and pre-control and management functions with multi-purpose. The consequences of recession of modesty principle was not negative,neither endanger human rights law,nor destroy the legislative system of the dual system.
