摘 要:经营者信息提供义务的履行程度会对消费者的意思决定环境构成影响,这一命题似乎极易被忽视。从民法逻辑体系上重新审视交易主体之间在信息能力上的构造性差距,并以此作为信息提供义务生成的正当性基础,不失为一种可选择的解释方法。进而,在对侵害该正当性基础的救济问题上,应依照比较法上的经验,重视民法可撤销制度对于《消费者权益保护法》的支援价值,通过提供可借鉴的判断标准,使解决交易主体之间的利益冲突更具可操作性。The degree of fulfillment of the information provision obligation by businesses will have an impact on how the consumers make decisions. But this seems to be easily overlooked. Re-examining the structural gap in the information capabilities between the transaction entities in terms of the civil law logic system and using this as the legitimacy basis for the information provision obligation are an alternative interpretation method. Furthermore, regarding remedy for the violation of the legitimacy basis, we should pay attention to the role of the withdrawal system under the Civil Law in supporting the Consumer Protection Law in light of the comparative law experiences, and make the resolution of conflicts of interest between transaction entities more viable by providingjudffinK standard for its reference.
