摘 要:行政协议的传统判断标准已经随着公私融合的加深被打破。原有的以行政目的、公共利益为基础构建的行政协议已经不能适应我国目前行政协议适用范围扩张的趋势。域外的行政协议扩张特殊判断标准我们可以借鉴拟或适用。在这些特殊标准之下,应当考虑合同的具体内容,公私属性兼顾的协议可以被视为行政协议。对于行政协议适用导致公权力不当行使,应当通过制定一套完整的关于行政协议的公法规则,以平衡行政协议当中的公、私主体利益,而不是通过抑制行政协议的适用范围来保证私主体的利益实现。The traditional criterion of administrative agreement has been broken with the deepe- ning of public and private integration. The existing administrative agreements based on administrative purposes and public interests have not been able to adapt to the current trend of expansion of the application scope of administrative agreements in China. Thereis a special judgment standard for the expansion of administrative agreement outside the region, which needs to be taken seriously by the current academic circle. Under these special standards, consideration should be given to the specific content of the contract, which can be regarded as an administrative agreement. For improper admin- istrative agreement applicable to public power exercise, should be worked out by a complete set of administrative law rules of the agreement, in order to balance the interests of the subject of administrative agreement among public, private, rather than by inhibiting the applicable scope of the administrative agreement to ensure that the interests of the private person.
