论法律实务职业入门“三要素”——以诊所法律课程为例

摘　　要：本文以法律实务入门职位选择的＂事务实操性＂、＂环境规范性＂与＂指引有效性＂三要素为基点,探索了法律实习中机构、指导人员、实习生及院校之间的法律关系与职责。以某高校民事行政诉讼诊所教学经验为例,分析了现阶段法律实习存在问题的原因所在,并提出了外部引导与自我驱动相结合、立体开发案例的培训教育价值,以及增强实习生对实务情形合法性与法律公正性的识别能力作为完善与改进的对策。＂Practical＂, ＂ normative ＂ and ＂ guidance ＂ are the three elements of the fundamental point for legal internship which makes the legal relationship and responsibilities among institutions,guidance personnel,universities and interns.Legal clinic experiences in someone university demonstrates how the elements run and what the problems are.Rebuilding the three elements should depend on reinforcing cooperation between guidance and students,developing case training value and enhancing the ability of students to identify practical legitimacy and legal impartiality.
