摘 要:我国传统的国际私法教学是以学理为中心的教学体系,忽视了法律的实践理性,在我国深度参与全球经济治理的时代背景下,难以满足涉外法律人才培养的现实需求。裁判中心主义是以国际私法裁判为场景、以国际私法法律思维训练为核心、以培养涉外法律事务处理能力为目标的教学体系。裁判中心主义以环形思维的建立、程序与实体问题的融合、比较法说服功能的贯彻、准据法的选择为核心要素。裁判中心主义重构了国际私法的教学内容,由涉外性的判断、识别、涉外民商事程序法、法律选择的方法与规则、准据法的查明与适用5个部分组成。The traditional teaching of private international law in China pays more attention to theories, ignoring the practical nature of law, which cannot meet the need of international legal talent cultivation in the context that China has a deep participation in global economic governance. The" Adjudication-based Approach " is a teaching system which is based on the private international lawsuit(international civil and commercial litigation or arbitration), focusing on the training of private international law thoughts,aiming to fostering the ability of dealing international legal affairs. From the view of the core elements of the Adjudication-based Approach, it includes the establishment of circular thinking model, the integration of procedural and substantive issues, implementing the persuasive function of comparative law and the proper application of laws. From the view of the teaching content,the Adjudication-based Approach reconstructs the teaching content of private international law. It consists of five parts, the judgment of foreign factors,identification, the foreign-related civil and commercial procedural law, the rules of the application of law,and the proof of foreign law.
